Appendix No. 1 to the Regulations of participation in the Meet Magento Poland Conference - Privacy Policy

I. Personal Data Administrator:

The administrator of the personal data of Participants, Speakers and entities represented by them is QANUK.AI limited liability company, 11 Mostowa Street, 61-854 Poznań (hereinafter: the Administrator).

II. Data Protection Principles:

  1. The Administrator undertakes to take appropriate measures to protect the data from unauthorized access by third parties or unauthorized disclosure to third parties.
  2. The administrator informs that the database of the website https://meetmagento.pl/ are protected from viewing and access by unauthorized third parties.
  3. The Administrator shall select with due diligence and apply appropriate technical and organizational measures to ensure the protection of the processed personal data. Only authorized persons have access to personal data.

III. Purpose and basis of data processing:

Personal data of Conference Participants and Speakers are processed for the following purposes:

  • to perform and on the basis of the agreement concluded by Participants or Speakers with the Administrator regarding participation in the Conference, or to take action by the Administrator at the request of Participants or Speakers prior to concluding the agreement for participation in the Conference (the basis of Article 6(1)(b) of the DPA*),
  • to fulfill the Administrator's legal obligations under mandatory provisions of European Union law or Polish law (e.g. accounting and tax obligations) - because the processing of personal data is necessary to fulfill the legal requirements to which the Administrator is subject (Article 6(1)(c) of the RODO*),
  • providing payment services, ensuring the security of services that the Administrator provides electronically, handling requests transmitted e.g. through the contact form in a situation when they are not directly related to the performance of the contract, performance of the contract for participation in the Conference, if the contract is concluded by the Administrator with a third party, and the beneficiary is a Participant or a Speaker, debt collection, conducting judicial, enforcement, administrative and mediation proceedings, storing data for archival purposes, statistical purposes and to ensure accountability (fulfillment of obligations under mandatory provisions of European Union or Polish law), to use the image for the purposes of broadcasting in the mass media or for documentation, promotion, or advertising purposes - because the processing is necessary for the realization of our legitimate interests which are: servicing the services provided and ensuring their security, fulfilling your requests, fulfilling the contract for participation in the Conference, the possibility of establishing, asserting or defending against claims, archiving data, statistics, ensuring accountability, mass media broadcast, documentation, promotion or advertising (art. 6(1)(f) RODO*),
  • Direct marketing of products or services, including sending newsletters, storing data in cookies - based on your consent (Article 6(1)(a) of the RODO* in conjunction with Article 172 of the Telecommunications Law).
  • presentation of a certificate of inoculation against COVID-19 in case of participation in the Conference in a stationary form - on the basis of your consent (Article 9(2)(a) of the DPA*).

Personal data of entities represented by Conference Participants and Speakers are processed for the following purposes:

  • to perform and on the basis of the agreement concluded with the Administrator regarding participation in the Conference or to take action by the Administrator at the request of the entity represented by the Conference Participant or Speaker prior to concluding the agreement for participation in the Conference (basis of Article 6(1)(b) of the DPA*),
  • to fulfill the Administrator's legal obligations under mandatory provisions of European Union law or Polish law (e.g. accounting and tax obligations) - because the processing of personal data is necessary to fulfill the legal requirements to which the Administrator is subject (Article 6(1)(c) of the RODO*),
  • to provide payment services, to ensure the security of services that the Administrator provides electronically, to handle requests submitted, for example, through the contact form, when they are not directly related to the performance of the contract, to conduct judicial, enforcement, administrative and mediation proceedings. through the contact form in a situation where they are not directly related to the performance of the contract, debt collection, conducting judicial, enforcement, administrative and mediation proceedings, storing data for archival and statistical purposes, and ensuring accountability (fulfillment of obligations arising from mandatory provisions of European Union or Polish law) - because processing is necessary for the implementation of our legitimate interests which are: servicing the services provided and ensuring their security, the implementation of your requests, the ability to establish, assert or defend against claims, data archiving, statistics, ensuring accountability (art. 6(1)(f) RODO*),
  • Direct marketing of products or services, including sending newsletters, storing data in cookies - based on your consent (Article 6(1)(a) of the RODO* in conjunction with Article 172 of the Telecommunications Law).

IV. Categories of personal data:

  1. The Administrator will process the following categories of personal data of Conference Participants:
    • basic identification data,
    • address,
    • email address,
    • position,
    • type of activity,
    • Financial identifying information, including bank accounts,
    • basic identification data of the entity represented by the Participant,
    • image (only in the case of Participants of the Conference in the form of stationary),
    • Health data on the certificate of inoculation against COVID-19 (only for Participants of the Conference in the form of stationary).
  1. The Administrator will process the following categories of personal data of Conference Speakers:
    • basic identification data,
    • address,
    • email address,
    • phone number,
    • position,
    • type of activity,
    • Financial identifying information, including bank accounts,
    • basic identification data of the entity represented by the Speaker,
    • Personal data provided by the Speaker in his/her resume,
    • image,
    • Health data on the certificate of inoculation against COVID-19.
  1. The Administrator will process the following categories of personal data of entities represented by Conference Participants and Speakers:
    • basic identification data,
    • address,
    • email address,
    • type of activity,
    • Financial identifying information, including bank accounts.

V. Recipients of data:

Personal data may be shared with the following categories of entities:

  • Snowdog Sp. z o.o., 11 Mostowa St., 61-854 Poznań, Poland,
  • Magento Association, 2501 Chatham Rd. Suite 4201, Springfield, IL 62704, USA,
  • subcontractors, i.e. entities that the Administrator uses for their processing, i.e.: entities providing accounting and bookkeeping services, hosting services, IT services, cloud solution delivery services to the Administrator,
  • entities through which enrollment in the Conference takes place,
  • to other entities authorized under applicable law to receive them,

whereby such entities process personal data on the basis of a contract, including a contract for entrustment of personal data processing concluded with the Administrator, or on the basis of legal regulations.

VI. Data retention period:

  1. Personal data of Participants and Speakers will be stored for the following time periods:
    • personal data processed in order to perform and on the basis of the agreement concluded by the Participants or Speakers with the Administrator for participation in the Conference, or to take action by the Administrator at the request of the Participants or Speakers before concluding an agreement for participation in the Conference - until the completion of performance, termination or expiration of the agreement in question, with the proviso that sometimes personal data may also be processed after the completion of performance, termination or expiration of that agreement, but only if this is permitted or required under mandatory provisions of law, e.g. statute of limitations for potential claims under the agreement or statute of limitations for tax liabilities,
    • personal data processed for the purpose of fulfilling the Administrator's legal obligations under mandatory provisions of European Union law or Polish law (e.g. accounting and tax obligations) - until the expiration of data retention obligations under the law,
    • personal data processed for the purpose of providing payment services, ensuring the security of services that the Administrator provides electronically, handling requests submitted e.g. through the contact form in a situation when they are not directly related to the performance of the contract, performance of the contract for participation in the Conference, if the contract is concluded by the Administrator with a third party, debt collection, conducting judicial, enforcement, administrative and mediation proceedings, storing data for archival purposes, ensuring accountability and for statistical purposes (fulfilling obligations arising from mandatory provisions of European Union or Polish law) - until the expiration of the statute of limitations for all claims under the contract(s) or claims related to the processing of personal data, or until an objection is raised,
    • personal data processed for direct marketing of products or services, including sending newsletters, storing data in cookies - until you withdraw your consent or until you object, but for a maximum of 10 years.
    • personal health data regarding the certificate of inoculation against COVID-19 - until you withdraw your consent, but no longer than until the end of the Conference.
  1. Personal data of entities represented by Participants and Speakers of the Conference will be stored in the following time periods:
    • personal data processed in order to perform and on the basis of the contract concluded with the Administrator concerning participation in the Conference or to take action by the Administrator at the request of the entity represented by the Participant or the Conference Speaker prior to the conclusion of the contract for participation in the Conference - until the end of performance, termination or expiration of the contract in question, with the proviso that sometimes personal data may also be processed after the end of performance, termination or expiration of the contract, but only if this is permitted or required under mandatory provisions of law, e.g. the statute of limitations for potential claims under the contract or the statute of limitations for tax liabilities,
    • personal data processed for the purpose of fulfilling the Administrator's legal obligations under mandatory provisions of European Union law or Polish law (e.g. accounting and tax obligations) - until the expiration of data retention obligations under the law,
    • personal data processed for the purpose of providing payment services, ensuring the security of services that the Administrator provides electronically, handling requests submitted e.g. through the contact form in a situation where they are not directly related to the performance of the contract, debt collection, conducting judicial, enforcement, administrative and mediation proceedings, storing data for archival purposes, ensuring accountability and for statistical purposes (fulfilling obligations arising from mandatory provisions of European Union or Polish law) - until the expiration of the statute of limitations for all claims arising from the contract(s) or claims related to the processing of personal data, or until an objection is raised,
    • personal data processed for direct marketing of products or services, including sending newsletters, storing data in cookies - until you withdraw your consent or until you object, but for a maximum of 10 years.

VII. Rights to which Participants, Speakers and entities represented by Participants and Speakers of the Conference are entitled:

Participants, Speakers and entities represented by Participants and Speakers of the Conference have the following rights:

  1. The right to access your data and receive a copy of it,
  2. The right to rectify (amend) your data,
  3. The right to erasure If, in your opinion, there are no grounds for the Administrator to process your data, you may request that it be erased.
  4. The right to restrict data processing You have the right to have the Administrator restrict the processing of your personal data only to storing it or performing an action agreed with you, if in your opinion the Administrator has incorrect data about you or is processing it unduly; or you do not want it deleted because you need it to establish, assert or defend a claim; or for the duration of your objection to the processing.
  5. The right to object to the processing of your data "marketing" objection. You have the right to object to the processing of your data for direct marketing purposes. If you exercise this right - the Administrator will stop processing your data for this purpose. Objection due to special situation. You also have the right to object to the processing of your data on the basis of legitimate interests for purposes other than direct marketing, and when the processing is necessary for the Administrator to perform a task carried out in the public interest or for the exercise of public authority entrusted to the Administrator. You should then indicate to the Administrator your particular situation which, in your opinion, justifies the Administrator to stop the processing covered by the objection. The Administrator will stop processing your data for these purposes unless you demonstrate that the Administrator's grounds for processing your data override your rights, or your data are necessary for the Administrator to establish, assert or defend claims.
  6. The right to data portability You have the right to receive from the Administrator in a structured, commonly used machine-readable format (e.g., ".csv" format) personal data concerning you that you have provided on the basis of a contract or your consent when the processing is carried out by automated means. You may also instruct the Administrator to send this data directly to another entity.
  7. The right to lodge a complaint with a supervisory authority If you believe that the Administrator is processing data unlawfully, you may lodge a complaint about it with the President of the Office for Personal Data Protection.
  8. The right to withdraw consent to the processing of personal data At any time you may withdraw your consent to the processing of such personal data that the Administrator processes on the basis of your consent. Withdrawal of consent will not affect the lawfulness of the processing that was carried out on the basis of your consent before its withdrawal.

VIII. Information on the requirement/voluntariness of providing data:

Provision of your data processed for participation in the Conference is voluntary, but is a condition for participation in the Conference. Provision of data for direct marketing of products or services, including sending newsletters, saving data in cookies, and health data is voluntary.

IX. Information about the source of the data:

The personal data of the entities represented by the Participants or Speakers of the Conference was obtained by the Administrator from the Participant or Speaker.

X. Cookies:

  1. Within the website https://meetmagento.pl/ cookies are used, by which is meant IT data, in particular text files, stored in the users' terminal equipment intended for the use of the website.
  2. The information collected with cookies allows us to customize services and content to individual users' needs and preferences, as well as to compile general statistics on users' use of the website.
  3. Personal information collected using cookies is collected solely for the purpose of performing certain functions for the benefit of users and is encrypted in a way that prevents unauthorized access.
  4. As a rule, two types of cookies are used - "session" and "permanent":
    • Session cookies are temporary files that remain on your device until you leave the website or turn off your software (web browser);
    • permanent cookies are files that remain on the user's device for the time specified in the parameters of the cookies or until they are manually deleted by the user.
  1. Web browsing software (Internet browser) usually allows cookies to be stored on the user's terminal device by default. The user can change the settings in this regard. The web browser allows you to delete cookies. It is also possible to automatically block cookies For details, please refer to the help or documentation of your web browser. Mostowa 11, 61 - 854 Poznań (KRS: 0000824946) of telecommunication terminal devices (e.g. computer, tablet and others) and automatic calling systems, for the purposes of direct marketing, including receipt of newsletters (e.g. e-mail).

 

The consent in question may be withdrawn at any time. The withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. Consent can be withdrawn by directing a notice of withdrawal in one of the ways indicated below:
